Usage Rights:

Effective Upon Purchase
This agreement is between Abe Snider ("Content Provider") and the individual or entity that purchases or downloads the image (“Licensee”) via www.abesnider.com

By completing the purchase or download, the Licensee affirms agreement to the terms below.

1. Licensed Media

• Image Title/Description: Blue Heron Photograph (Media)

• Purpose: Cover image for a single book (print and ebook)

• Distribution Limit: Up to 500 printed copies

• License Type: Non-exclusive commercial use

• License Duration: Five (5) years from date of purchase

• Delivery: High-resolution digital file download provided upon purchase or via email

2. Grant of License

The Content Provider grants the Licensee a limited, non-exclusive, non-transferable, and non-sub-licensable license to use the Media for:

• A single book project (cover only)

• Print and ebook formats

• Edits of the media for layout/design purposes

This license allows commercial use for this specific project only. The Media may not be resold, re-licensed, sub-licensed, or printed and sold as standalone art or merchandise.

Promotional Use Exception
As an additional use within this license, the Licensee may use the book cover design (including the licensed image) on a limited number of non-commercial promotional items (e.g., coffee mugs, bookmarks, stickers) for the purposes of marketing, giveaways, or gifts. These items may not be sold or distributed as standalone merchandise, and this clause does not extend to commercial merchandising rights.

3. Exclusions and Restrictions

The Licensee may not:

• Use the Media in any other projects, books, or formats outside of this license

• Sell or distribute the digital file

• Transfer the license to another party

• Use the image for any product offered for resale (e.g. posters, fine art prints, merchandise)

If the book is picked up by a publisher, translated, expanded in format, or reprinted beyond 500 copies, the Licensee agrees to renegotiate usage terms in good faith with the Content Provider.

4. Ownership and Copyright

All copyright and ownership of the Media remain exclusively with the Content Provider. This license grants only the limited rights specified above; it does not transfer any ownership interest.

5. Photo Credit

A credit line must appear on the indicia or copyright page of the book:

6. Limitation of Liability

The Media are provided “as is” with no warranties, express or implied. The Content Provider shall not be liable for any third-party claims, incidental, consequential, or indirect damages resulting from use of the Media.

7. Length of Term

This license remains valid for five (5) years from the date of purchase. It is revoked immediately if any term is violated, at which point all use of the Media must cease.

**Expanded Use During License Term**  
If the book exceeds the initial 500-copy print run, is picked up by a publisher, is adapted into additional formats (such as audiobook or foreign-language editions), or experiences unexpected commercial success during the license term, the Licensee agrees to notify the Content Provider and enter into good faith negotiations to extend or expand the license as needed. The Content Provider agrees to work reasonably and collaboratively in such a case to support the ongoing success of the project.

*Optional Renewal Clause**  
The Licensee may renew this license for an additional five (5) years under the same terms and conditions, for a renewal fee of $275 USD, provided that the renewal is requested within sixty (60) days before or after the original expiration date. Any future extensions beyond that period may be negotiated in good faith at that time.

8. Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of the State of Arizona, USA.
